Supreme Court upholds ex-Gov Dariye’s 10-yr jail term [update]

The Supreme Court has, on Friday, upheld the on June 12, 2018, judgment of the Federal High Court which slammed a 10-year sentence on former governor of Plateau State, Senator Joshua Dariye.

Senator Dariye, it could be recalled, was convicted on the offence of criminal breach of trust in a judgement by Justice Adebukola Banjoko of the High Court of the Federal Capital Territory (FCT), delivered on June 12, 2018.

The trial court convicted and sentenced him to 10 years for diverting public funds estimated at N1.162 billion while he was governor of Plateau State.

The court convicted Dariye on 15 counts out of the 23-count charge relating to the offences of criminal breach of trust and criminal misappropriation proffered by the Economic and Financial Crimes Commission (EFCC).

The lead judgment, prepared by Justice Ejembi Eko of the Supreme Court, was read by Justice Helen Ogunwumiju.

A five-man panel, which includes Lawal Garba, Samuel Oseji and Tijani Abubakar, unanimously upheld the judgment.

The apex court, however, quashed the one-year sentence imposed on him by the Court of Appeal over criminal misappropriation.

The appellate court, in its judgement on November 16, 2018, had upheld the first instance sentence and imposed another one-year sentence on him for criminal misappropriation.

The Court upheld Dariye’s concurrent conviction and sentence by the trial court and the Court of Appeal on the offence of criminal breach.

Dariye had approached the Supreme Court asking it to upturn the judgment of the Court of Appeal, Abuja.
