Edo guber: Appeal Court reverses ruling voiding PDP primary
The Court of Appeal sitting in Abuja has overturned a Federal High Court judgement that mandated the Peoples Democratic Party (PDP) to permit the participation of 381 ad-hoc delegates in its February 22 primary election in Edo State.
The primary election which produced Asue Ighodalo as governorship candidate.
A three-member panel of the appellate court set aside the July 4, 2024, judgement delivered by Justice Inyang Ekwo, stating that the trial court lacked jurisdiction to hear the case lodged by the aggrieved delegates, who did not possess the necessary legal rights to initiate the suit.
The Appellate Court held that only an aspirant who was seeking to run for political office has the right to challenge his exclusion at the Federal High Court, and not delegates seeking to elect the candidate of the party.
Also, the Court restated that no Court has the right to interfere with the domestic affairs of a political party to decide its choice of candidates.
Recall that the PDP approached the Appeal Court in its quest to resolve the matter ahead of the September 21 off cycle governorship election in Edo State.
Meanwhile, Kelvin Mohammed, Gabriel Okoduwa, Ederaho Osagie and on behalf of the 378 ad-hoc delegates, make up the list of respondents.
Others are the electoral body, INEC, the National Secretary of the PDP, and the Vice Chairman, PDP South-South.
