CJN summons judges over conflicting orders on Kano Emirship dispute

Olukayode Ariwoola, the chief justice of Nigeria (CJN), has summoned the chief judges of the federal high court and the Kano state high court over conflicting interim orders on the emirship dispute in Kano.

Both courts have issued conflicting interim injunctions over the face-off between Aminu Bayero, the deposed Emir; and Muhammadu Sanusi II, the reinstated Emir.

This judicial clash has left the state in a state of uncertainty.

Recall that trouble started when the Federal High Court in Kano, under Justice S. A. Amobeda, issued an interim injunction to evict Emir Muhammadu Sanusi II from the Kofar Kudu Palace.

The order tends to solidify the position of the 15th Emir of Kano, Aminu Ado Bayero who was unceremoniously booted out of office by the administration of governor Abbah Yusuf.

Justice Amobeda’s order not only facilitated the eviction but also reinforced Emir Bayero’s authority.

“An order of interim injunction restraining the respondents from inviting, arresting, detaining, threatening, intimidating, harassing the Applicant, or infringing on his rights is hereby granted,” Justice Amobeda ordered.

In a counter move, the Kano State High Court, headed by Justice Amina Adamu Aliyu, issued a protective injunction for Muhammadu Sanusi II and other key figures against potential state harassment.

This order was aimed at preserving the autonomy of the Emir and safeguarding symbolic items of authority such as the twin spear, the Royal Hat of Dabo, and the Ostrich-feathered shoes.

“An order of interim injunction is granted restraining the Respondents from harassing or intimidating the Applicants or confiscating any symbols of the Emir’s authority,” Justice Aliyu stated.

She further directed that the status quo be maintained pending a detailed hearing and determination of the motion on notice.

However, following the uncertainty created by the judgments, Ariwoola summoned the Chief Judge of the Federal High Court, and the Chief Judge of Kano State High Court over conflicting interim injunctions regarding the Kano Emirate.

The intervention by the CJN seeks to bring clarity and resolve the conflicting judicial pronouncements, aiming to restore order and stability in the Kano Emirate.
