Appeal court upholds Edozie Njoku as APGA boss, Victor Oye/Mahmood Yakubu’s contempt judgement

The Court of Appeal sitting in Abuja has upheld Chief Edozie Njoku as the National Chairman of the All Progressives Grand Alliance (APGA).

This was contained in a judgement delivered on June 28, 2024, by Hon. Justice U. Onyemenam, JCA, on Appeal numbers CA/ABJ/724/2023 and CA/ABJ/1169/2023.

Justice Onyemenam also upheld the judgement which convicted the former APGA chairman, Chief Victor Ike Oye, and the chairman of the Independent National Electoral Commission (INEC), Prof. Mahmood Yakubu, for contempt of court.

Ruling in the matters between Victor Oye and Otumba Camaru Lateef Ogidan and two others, the judge resolved all the reliefs sort in both appeals by the appellant, Victor Oye, in favour of the respondents.

Onyemenam ruled, amongst other things that the trial judge has jurisdiction to hear the case.

She also held that Chief Victor Oye disobeyed the orders of the court by conducting an illegal congress and national convention against court orders.

She further ruled that the Owerri convention, which saw Chief Edozie Njoku emerge as APGA chairman, was valid.

Hence, Chief Njoku was properly and duly elected as the National Chairman of APGA, the judge ruled.

Ruling on the contempt judgement against Victor Oye and Mahmood Yakubu at the lower court, Onyemenam held that the judgment was in Order and must be properly executed.

The appellate court court further resolved as follows:

  • that the judgement obtained by Chief Victor Oye from Anambra state high court from Justice Ozor was fraudulent, illegal, forum shopping and abuse of Court processed, hence, complete thrash.
  • that justice M.A Madugu of the FCT high court was right declaring that Chief Edozie Njoku should be recognized as the national chairman of APGA as decided by the Supreme Court.
  • that M.A Madugu was right in declaring that Chief Victor Oye should vacate the National Secretariat for Chief Edozie Njoku to occupy the seat as the rightful National Chairman.
  • that justice M.A Madugu’s declaration that Chief Edozie Njoku should be recognized by INEC stands.
  • that the declaration that all the actions taken by Chief Victor Oye and Mahmood Yakubu in conducting congresses, convention, primaries, meetings or flag off of campaign of any kind is Illegal, fraudulent, null and void.
  • that Chief Victor Oye and Mahmood Yakubu are liable to be sentenced to prison for disobeying the orders of the court unless they purge themselves.
  • that both Chief Victor Oye and Mahmood Yakubu are in contempt of the court.
