APC moves to legitimize Maciver, the criminal terrorist Bayelsa deputy guber candidate

...produces document showing that Yar’Adua granted him amnesty

The Bayelsa State chapter of the All Progressives Congress (APC) has embarked on moves to legitimize the deputy governorship candidacy of Joshua Maciver, the criminal terrorist who is currently the running mate to Timipre Marlin Sylva, the APC candidate for the governorship election coming up in November 2023 in the state.

Background of Maciver

According to two separate articles published by News Band on July 11, 2023, and based on a story written by Jackson Ude, a former presidential aide to former President Goodluck Jonathan, Joshua Maciver, was a convicted Niger Delta murderer and terrorist jailed and incarcerated in Kaduna Prison.

He, however, escaped from Kaduna Prison in 2006 after being convicted of murder and terrorism.

Another notorious criminal and Niger Delta warlord, Asari Dokubo, was at the same time incarcerated in Kuje Prison in Abuja.

Government Oweizide Ekpemupolo aka Tompolo, tired of Niger Delta agitators being hauled into prisons, marshalled out a plan to break Kuje Prison and free Dokubo.

On the D-Day, in 2006, Dokubo called Tompolo to say he had a dream and that he died during the operation to free him but Tompolo surged ahead with his plan.

 Dokubo reportedly switched off his phones and asked the Prison officials to take him to the underground and by the time the militants arrived he was incommunicado.

Tompolo, undaunted, ordered his men to proceed to Kaduna where was a certain Joshua Maciver, a Niger Delta militant, was serving sentence in Kaduna Prison.

Maciver was called and told to urgently prepare for an escape. He in turn alerted prison officials he was seriously sick needed urgent medical attention.

Tompolo boys, armed to the teeth with assault weapons, bombs and all kinds of top military weapons, arrived Kaduna Prison, shooting, killing, and eventually broke into the prison and set Joshua Maciver free.

Ude, however, did not stop at the escape from prison story as he went ahead to furnish documentary evidence that no record exists to show Maciver was granted a presidential pardon or even enlisted into the Presidential Amnesty Program (PAP) of late President Umaru Musa Yar’Adua in an update to his report.

The first document is a letter written by the Permanent Secretary (General Services Office, Mr. Nnamdi Maurice Mbaeri, on behalf of the Secretary to the Government of the Federation and addressed to the Interim Administrator of the Presidential Amnesty Program dated July 7, 2023.

The writer requested confirmation of unconditional pardon granted to Joshua Maciver by the later President Yar’Adua.

A source said that the enquiry was initiated following allegation that Maciver forged a PAP identity card, despite the fact that no record in the amnesty office shows he is part of the amnesty program granted by the late President Yar’Adua’s administration.

In a swift response from the Interim Administrator of the Presidential Amnesty Program with the same date and addressed to the Secretary to the Government of the Federation, meanwhile, PAP denied that Mr. Maciver was ever granted amnesty

In a letter, which is a prompt reply signed by the Interim Administrator, Major General Barry Tariye Ndiomu (rtd.), PAP clearly stated that “there is no record in the Presidential Amnesty Program (PAP) to show that Mr. Joshua Maciver of Bayelsa State is a beneficiary of PAP”. (Emphasis ours.)

It added that “his name does not appear in the data bank of PAP either as an ex-agitator or delegate” (emphasis ours) and that his name is not “connected to any of the camps registered in PAP”.

SHOCKING: Timipre Sylva, Bayelsa APC guber candidate allegedly picks convicted
murderer as running mate

Following the “shocking” discovery by the camp of Sylva indicating that they had committed a foul in the 18-meter box, they were dumbfounded and left in a state of confusion.

It was, therefore, another rabbit out of the hat when Bayelsa APC produced a document purportedly from the Nigerian Correctional Centre (NCS) believed by observers to be “fake”.

The document declared that the former ex-militant leader and deputy governorship candidate, MacIver, has no pending prison sentence obligation in its bid to legitimise his candidacy.

The document purportedly signed by the Controller-General of Corrections, Haliru Nababa, claimed that the Bayelsa APC deputy governorship candidate was granted amnesty under Yar’Adua.

APC claimed that Nababa, “in a leaked document titled, ‘To Whom It May Concern’, clarified that Maciver was granted amnesty alongside other Niger Delta militants by the late President Umaru Yar’Adua”. (Emphasis ours.)

In the document, Nababa, in a letter addressed to Benjamin Ogbara, the lawyer to MacIver, said the amnesty proclamation ended Maciver’s prison sentence at the Kaduna prisons.

It also claimed that the controller-general also attached the official gazette containing the amnesty proclamation and other relevant documents to prove that MacIver was cleared of all offences.

The document claimed that Nababa said as follows:

“This is to confirm that Mr. Joshua MacIver, who was serving a prison sentence in Kaduna Prisons following his conviction in charge number FHC/KD/119C/2004, on the 26th of February, 2006 was granted Amnesty alongside other Niger Delta militants by President Umaru Musa Yar’Adua.

“This is in pursuant to the Amnesty Proclamation dated the 25th of June, 2009 in exercise of the powers vested on the President of the Federal Republic of Nigeria under section 175 of the Constitution of the Federal Republic of Nigeria.

“He is, therefore, no longer under any legal obligation to continue to serve the prison sentence. Please, find attached the official gazette containing the amnesty proclamation and other relevant documents”.

In the meantime, though, a Federal High Court sitting in Abuja has disqualified the APC governorship candidate, Chief Sylva, from contesting the November 11 off-cycle election in Bayelsa State.

Justice Donatus Okorowo gave the judgement on October 10, 2023, which if affirmed by the appellate court, will result to the party not participating in the state governorship election.

On his part, Sylva has appealed the judgment of the Federal High Court which nullified his candidacy as the APC flag bearer in the election.
