How Victor Oye Was Removed As APGA Chairman [Summary]

On the 5th of October, 2016, The meeting of NWC of our party APGA as summoned by Victor Oye the then national chairman, now removed. 24 out of the 29 members of the committee attended.

Issues of constitutional breaches by the national chairman was raised by Jerry Obasi (dep. Nat. Sec) at the floor of the meeting.

Chuks Nwoga, National Youth Leader (NYL) moved a motion for the suspension of the national chairman and was supported by Alhaji Aminu Furo joda (Dep. Nat. Welfare Sec). 13 out 24 voted in favour of his removal.

Oye was suspended alongside his two deputies: Uchenna Okogbue (south) and Alh Adamu (North).

Chief Okechukwu nkolagu (Dep. Nat. Fin Sec) moved a motion for the appointment of Ozo Nwabueze Okafor (Nat. Vice chairman, S/E)as the Acting national chairman who is next in line of succession.

His motion was supported by Ezinne Amaka agbiogwu (NWL).

Committee was set up to look into the offences of Oye and his 2 deputies. The committee was chaired by Chuks Nwoga (NYL) and his secretary was Terry Godfrey (Dep. Nat. treasurer).

Two letters of invitation were sent to Oye and his 2 deputies to answer the allegations of misconduct against them but they declined. The letters were dated 6/10/16 and 14/10/16.

After 2 previous invitation which Oye and his Two deputies refused to appear before the panel, the committee sat on the 18/10/16 and made their findings and recommendations.

Ozo Nwabueze okafor and APGA approached the FCT high court to ask Oye to stop parading himself as the national chairman of APGA.

On 18/11/16, NWC meeting chaired by Ozo Nwabueze Okafor was held were Ochudo Martin Agbaso was nominated as the deputy national chairman south.

Some other vacant national offices were also filled on the said meeting. Issues of absenteeism was also raised.

On 7/12/16, reports from the committees set up from the previous meeting was adopted. New national officers nominated to replace the habitual absentee officers in line with APGA’s constitution.

On 8/1/17,the acting national chairman Ozo Nwabueze Okafor died.

On 30/1/17, after the burial of Ozo Nwabueze okafor, NWC met at Enugu and mandated  Ochudo Martin Agbaso who was the acting deputy national chairman south to take over the leadership of the party since he is the next in line of succession in accordance to the party’s constitution.

On 3/2/17, a letter was sent to INEC to notify them about the change in leadership.

Comrade Mike Alioke who is the Deputy Chairman of APGA in Enugu approach a high court in Enugu praying the court to order INEC and Police to obey the decision of NWC by recognizing Ochudo Martin Agbaso as the acting national chairman of APGA which the court granted on 22/5/17 by issuing an order of mandamus against INEC and police via suit no. E/291M/2017.

Police appealed the mandamus order in suit no. CA/E/371/2017 on 23/6/17.

Oye applied for leave to appeal and to stay execution of the mandamus order in suit no. CA/E/358m/2017.

The leave was granted but the stay was declined. Delivered on 10/7/2017.

On 6/7/17, Tochukwu Maduka & co wrote to INEC and AGF on INEC refusal to obey court order. Both letters where delivered and received on 10/7/17.

On 14/7/17, a letter was sent to INEC to submit both the judgement of high court and that of the appeal court that upheld the mandamus order. The letter was received and acknowledged by INEC.

On 20/7/17, Tochukwu Maduka & co on behalf of APGA wrote INEC asking them to confirm to them who is the authentic national chairman of APGA which INEC did not respond to.

On 14/7/17, notification for Congresses and primary election of APGA in Anambra state was sent to INEC. It was received and acknowledged.

On 18/7/17, INEC was notified about the party’s NEC meeting and national convention held on 10th and 11th August 2017 respectively at Owerri. The letter was received and acknowledged by INEC on 19/7/17.

A letter dated 13/7/17 was sent to IGP on 20/7/17 to request for police protection for the Anambra state Congresses and primary election. The letter was received and acknowledged.

On 5/7/17, INEC withdrew from suit no. E/291/2017

On 24/7/17, police withdrew on the case on suit no. CA/E/371/2017.

A letter dated 21/7/17 was sent to the commandant general of civil defence corps for protection for the Anambra state Congresses and primary election. The letter was received and acknowledged same day.

A letter dated 11/8/17 was sent to the director of DSS on 14/8/17 notifying him about the Anambra Congresses and primary election.it was received and acknowledged

On 21/7/17, an appeal was filled at the Supreme Court with suit No’s.:SC597/17,SC598/17, SC599/17, SC600/17, SC601/17.

On 31/7/17, Tochukwu Maduka & co wrote a letter to the President of Court of Appeal in response to a letter from Olanipekun, SAN, requesting for vacation judges on the appeal with suit no. CA/E/367/2017; Dr Victor Oye v comrade Mike Alioke & ors. The letter was received and acknowledged on 1/8/17.

On 27/7/17, a letter was sent to INEC to notify them on the change of date of Anambra state Congresses and primary election. The letter was received and acknowledged on 1/8/17.

A letter dated 12/8/17 was sent to INEC on 14/8/17 to notify them of the removal of Labaran Maku as the national Secretary of APGA by the NWC and NEC of the party. The letter was copied to the legal department and EPM which they received and acknowledged.

On 18/8/17, a letter was sent to INEC to notify them of the pendency of the motion for stay of execution and injunction pending appeal in suit CA/E/367/2017 Dr Victor Oye v APGA and ors. It was received and acknowledged same day.

On 16/8/17,the Appeal Court judges headed by justice Aboki vacated the order of mandamus on appeal no.CA/E/367/2017;Dr Victor Oye v. Comrade Mike Alioke and ors even when the case is pending at the Supreme Court in suit No’s;sc597,sc598 etc.

On 17/8/17, an appeal was filled at the supreme court with suit no. Sc718/17 challenge the decision of the Appeal Court in suit no. CA/E/367/2017; Dr Victor Oye v. Comrade Mike Alioke and ors.

A letter dated 11/8/17 was sent to INEC on 14/8/17 which is the resolution of APGA national convention held at Owerri on11/8/17 .it was received and acknowledged.

On 14/8/17, the legal department of INEC received and acknowledged the report of the national convention held on 11/8/17 at Owerri. The report was received by Alison adamah.

On the 5/9/17, a letter was sent to INEC requesting for the proscribed nomination form for the party’s nominated candidate for Anambra governorship election.

The letter was addressed to the INEC chairman and copied to EPM and legal department.

Both the chairman and EPM refused to receive the letter that was copied to the legal department and was received by saleh N. Ibrahim, for: DLS on 5/9/17

On 6/10/17, a bailiff of Court of Appeal Enugu division, Aniegbunam Amaechi served notice of appeal, supplementary record to police at their headquarters in Enugu. He deposed to affidavit of service thereafter.

On 5/10/17, the same bailiff served a supplementary notice of appeal to INEC Enugu. It was received by Amaka Ezekwe on behalf of INEC. He deposed to an affidavit of service

On 20/11/17, same bailiff served Dr Victor Oye in the presence of his P.A at his Awka residence. He also deposed to an affidavit of service.

The matter has been adopted for final verdict in the Supreme Court for July 3, 2018.
