Supreme Court releases corrected enrolment order deleting Oye’s name as APGA chair

The Supreme Court of Nigeria has released the corrected enrolment order of the judgment that deleted the name of Chief Ike Victor Oye as the national chairman of the All Progressives Grand Alliance (APGA) on Friday, 24th March, 2023.

The enrolment order on appeal number SC/CV/687/2021 and CA/KN/146/2021, also stipulated that Chief Edozie Njoku be recognized as the authentic APGA national chairman.

The case was between Chief Jude Okeke as Appellant, APGA, Chief Oye, Alhaji Rabiu Garba Aliyu, and the Independent National Electoral Commission (INEC) as Respondents.

It also had Chief Njoku as an Interested Person/Applicant.

The matter was brought before Supreme Court Justices Hon. Justice Kudirat Montomori O. Kekere-Ekun Justice, Hon. Justice Uwani Musa Abba Aji Justice, Hon. Justice Mohammed Lawal Garba Justice, Hon. Justice Ibrahim Mohammed Musa Saulawa, and Hon. Justice Emmanuel Akomaye Agim Justice, for the following determination:

  1. That Edozie Njoku, the applicant, be granted leave to bring the present Application as an interested party to the present appeal.
  2. pursuant to Order 8 Rule 16 of the Supreme Court Rules and the inherent powers of the Court, to correct the following typographical error and an accidental slip in the lead Judgment of this Honourable Court in the above Appeal presided over by and delivered by Hon. Justice Mary Ukaego Peter-Odili (JSC) (now retired):

a) Correcting the Appeal number wrongly stated as to be “SC/CV/686/2021″to the correct Appeal number which is “SC/CV/687/2021”.

b) Correcting an accidental slip at page 13 lines 3-4 of the judgment where instead of stating the name of “Chief Edozie Njoku” who was alleged to have been removed by the parties and whom the learned trial judge held to have been lawfully removed from his position as the validly elected National Chairman of APGA at the Party’s Congress held at Owerri; mistakenly %Ailed the name of “Chief Victor Oye” whose name was never mentioned at trial court.

Mr. C. G. Onyemenam, SAN, with J.G.E Ejeuko Esquire, I. N. Nke Esquire, P. Ntui Esquire and C. C. Ebume Esquire were the Counsel for Chief Edozie, while Lukman Asinmi Esquire represented Jude Okeke.

Mr. Onyechi Ikpeazu, SAN, in company of P. I. N. Ikwueto SAN, C. I. Mbaeri Esquire and Celestine Ezeokeke Esquire were the Counsel for APGA and Victor Oye.

After the hearing, the Supreme Court had ordered as follows:

  1. that the Appeal No. SC/CV/686/2021 set out on the face of the Judgment delivered by the Court on 14th October, 2021 is to be corrected and replaced with the Appeal No. SC/CV/687/2021.
  2. that the name of “Chief Victor Oye” mentioned and set out on page 13 of the Judgment delivered by the Court on the 14th October, 2021 in Appeal No. SC/CV/687/2021 be deleted and replaced with the name “Edozie Njoku” so that the sentence on page 13 would now correctly reads:“it needs to be stated at this point that the dispute being who should be the Acting National Chairman of the 1st Respondent, APGA and whether the Chairman, Edozie Njoku was validly replaced are within the confines of the internal affairs of the 1st Respondent which is not justiciable.”
