Is Nigeria now Sharia compliant?
An explanation on SUKUK Islamic finance!
Nemo judex in causa sua and audi alteram partem out of the windows in this Buhari/ Fulani led administration…
The purpose of this Paper is to remind us of the urgent need to have a reflection on the future of lives of Nigerians generally as well as Christianity in Nigeria and its implication to the unity of our great country.
Once, the military President Ibrahim Babangida dragged secular, multi-religious Nigeria into the Organization of Islamic Cooperation (OIC). Then, General Sani Abacha took Nigeria into another exclusive political club of Muslim Heads of State miscalled Development Eight (D-8). President Buhari also dragged Nigeria into Saudi-led Islamic coalition against terrorism – data.unhcr.org in 2016.
We are all aware of the incongruity of Nigeria’s membership of OIC and D-8 to the Provisions of Part II, Chapter IV, Section 42, Sub-section I (a) and (b) of the 1999 Constitution of the Federal Republic of Nigeria and their implications to both the secularity of the Nigerian nation and freedom of worship. As the “Declaration” of the Charter of the Organization of Islamic Cooperation (OIC) clearly states: In the name of Allah, the most Compassionate, the most Merciful,
We the Member States of the Organisation of Islamic Cooperation, determined: to acknowledge the Conference of Kings, Heads of State and Government of the Member States convened in Rabat from 9 to 12 Rajab, 1389 H, corresponding to 22 to 25 September 1969, as well as the Conference of,
Foreign Ministers held in Jeddah from 14 to 18 Muharram 1392 H corresponding to 29 February to 4 March 1972; to be guided by the noble Islamic values of unity and fraternity, and affirming the essentiality of promoting and consolidating the unity and solidarity among the Member States in securing their common interests at the international arena; Article 1(2) states:
To safeguard and protect the common interests and support the legitimate causes of the Member States and coordinate and unify the efforts of the Member States in view of the challenges faced by the Islamic world in particular and the international community in general; Article 1(8) puts it thus:
To support and empower the Palestinian people to exercise their right to self-determination and establish their sovereign State with Al-Quds Al-Sharif as its capital, while safeguarding its historic and Islamic character as well as the Holy places therein; Article I (9) on the other hand states inter alia:
To strengthen intra-Islamic economic and trade cooperation; in order to achieve economic integration leading to the establishment of an Islamic Common Market; For Article I (11) it is a clear case of:
To disseminate, promote and preserve the Islamic teachings and values based on moderation and tolerance, promote Islamic culture and safeguard Islamic heritage;
Finally comes the climax– Article 1(12): To protect and defend the true image of Islam, to combat defamation of Islam and encourage dialogue among civilisations and religions.
Consequently, it is imperative for the APC Government of the Federal Republic of Nigeria, to explain to the citizens of this nation, how the above provisions of the OIC Charter could be reconciled with the Provisions of Part II, Chapter IV, Section 42, Sub-section I (a) and (b) of the 1999 Constitution of the Federal Republic of Nigeria.
Thus, under President Muhammadu Buhari, Nigerians are again greeted with the same wind of crass policies of Islamization that clearly violate the Golden Provisions of Part II, Chapter IV, Section 42, Sub-section I (a) and (b) of the 1999 Constitution of the Federal Republic of Nigeria. Just like the cases of OIC and D–8, President Muhammadu Buhari has again dragged Nigeria into the 33-member exclusive Muslim military alignment under the leadership of Saudi Arabia.
The question here is, what other objectives in military alliance does Nigeria under President Muhammed Buhari intends to achieve which Nigeria’s military alliances under ECOWAS and AU could not achieve?
From the Islamic Military Alliance, Nigerians are again faced with the Islamization of the secular economy of the nation through the introduction of the exclusively Islamic Sukuk Bond as means of financing the national budget, the operations of which must comply with the provisions of Sharia laws, an action that has now metamorphosed into road construction.
In the mist of all these, the Boko Haram, ISWAP, Miyetti Allah and Fulani herdsmen are having upper hands in the Nigerian nation transmitting in form of terrorists, jihadists, insurgents, murderers, rapists, marauders, bandits, kidnappers, criminals, collaborators, ransom collectors, whatever, etc. Rather than Miyetti Allah to be proscribed as a terrorist group, they claim to have President as their chairman of board.
To the Christian leaders, where are those who organized the Episcopal House Fellowship campaigns for President Muhammadu Buhari? With this — Sukuk Bondage!
They need to explain this Sukuk in the context of allegations that those who are shouting islamization are seeking for appointment. Nigerian Christians really want their leaders to address this issue of the Sukuk Bondage, as they actually don’t understand it in practical terms.
Let the Nigerian Christian leaders tell us where they were, how they have benefited from the Inter-Faith Project with the Sultan of Sokoto in the light of the obvious threat of President Buhari-sponsored systematic jihad and outright discrimination against the Christians of this nation.
All these moves are unconstitutional. This is why Nigeria is fast disintegrating and every major tribe is seeking self-determination. This APC government and there supporters and well wishers would all have themselves to blame at last if Nigeria disintegrates!
As rightly posited by “The Human Rights Writers Association of Nigeria” (HURIWA), “It was illegal and unconstitutional for President Muhammadu Buhari to attend a summit exclusively convoked for Islamic nations under the aegis of Organisation of Islamic Cooperation (OIC) in Makkah, Saudi Arabia.
It said that Nigeria’s presence in such a body offends sections 10 and 42 of the 1999 Constitution since Nigeria is a secular or at least a multi-religious nation.” It also unconditional for Nigeria to be involved in any finance bond that is said to, “constitutes partial ownership in receivables as Sukuk” rather than interest.
Our history is replete with incidents of crass violations of the provision of the Nigerian Constitution with impunity by those who swore to obey, defend, and protect it; while those leaders whose moral, spiritual and political integrities demand their consistent and unflinching opposition against such desecrations standing akimbo with capricious mental declivity and unfathomable paranoiac syndrome of defeatism.
Remember, Nigeria is the most populous country in Africa, and the seventh-most populous country in the world, with an estimated population of 206 million.
Nigeria is a multinational state inhabited by more than 250 ethnic groups speaking 500 distinct languages, all identifying with a wide variety of cultures.
The three largest ethnic groups are the Hausa–Fulani in the north, Yoruba in the west, and Igbo in the east, together comprising over 60% of the total population with the minorities.
To-date, the official language is English, chosen to facilitate linguistic unity at the national level. Nigeria’s constitution ensures freedom of religion; and it is home to one of the world’s largest Christian and Muslim populations, simultaneously. Nigeria is divided roughly in half between Christians, who live mostly in the south; Muslims, who live mostly in the north, with minorities practicing indigenous religions, such as those native to the Igbo and Yoruba ethnicities. There is no room for fundamental Islamism in the Constitution of Nigeria.
