Lawyer drags NIPCO to court for allegedly ‘criminally defrauding’ him

An Abuja-based lawyer, Winston Chuks Obikwelu Esq., has dragged Nigerian Independent Petroleum Company (NIPCO) Plc. to the High Court of the Federal Capital Territory in Abuja for allegedly ‘criminally defrauding’ him.

This was contained in a suit filed on behalf of Obikwelu Esq. by his counsel, Atuegwu C. Okafor (Esq) of Primetime Solicitors, against NIPCO Plc. and two others, Alhaji Ahmed Mohammed and Malam Useni, with suit no: C1/868/2022.

In the Writ of Summons, the Claimant, Winston Chuks Obikwelu accused the Defendants, NIPCO, Alhaji Mohammed and Malam Useni, of defrauding him to the sum of three thousand five hundred thousand naira, which he said, “amounted to breach of contract for sale and purchase of Premium Motor Spirit (PMS)”.

Obikwelu sought the following reliefs from the court:

  1. A declaration that the actions of the defendants towards the claimant amounted to breach of contract for sale and purchase of Premium Motor Spirit (PMS) between the claimant and the defendants.
  2. A declaration that the actions of the defendants towards the claimant amounted to unauthorized conversion of the property (in this case money) of the claimant by the defendants.
  3. An order of court mandating the defendants to issue letter of apology to the claimant.
  4. The sum of N200,000,000.00 (two hundred million Naira only) as general damages for the breach of contract for sale and purchase of Premium Motor Spirit (PMS) between the claimant and the defendants
  5. The sum of N20,000,000.00 (twenty million Naira only) as compensation to the claimant for the wrong of conversion of the property (in this case money) of the claimant by the defendants.
  6. The sum of N365,000.00 (three hundred and sixty five thousand Naira only) as compensation to the claimant for the unauthorized use of the sum of N3,500.00 (three thousand five hundred thousand naira only) belonging to the claimant by the defendants for trading in petroleum business for one year being the period of 6th August 2021 to 5th August 2022.
  7. The sum of N 1,000.00 (one thousand Naira only) for every day, from 6th August 2022 until the defendants refund the withheld sum of N3,500.00 (three thousand, five hundred naira only) as compensation to the claimant for the unauthorized use of the money belonging to the claimant by the defendants for trading in petroleum business.

The court ordered the defendants to cause an appearance to be entered for them in an action at the suit of the Claimant within 14 (fourteen) days after the service of the writ.

The court warned that in default of the defendants to cause an appearance, the Claimant(s) may proceed therein, and judgment may be given in their absence.
