Election: Tinubu is a drug trafficking convict, disqualify him, Peter Obi asks Tribunal

The Labour Party (LP) candidate in the recently-held presidential election, Mr. Peter Gregory Obi, has asked the Presidential Election Petition Tribunal, sitting at the Court of Appeal Headquarters in Abuja, to disqualify the All Progressives Congress (APC) presidential candidate, Alhaji Bola Ahmed Tinubu, who was convicted for drug trafficking offences in the United States of America.

Mr. Obi made the demand in a petition filed at the Tribunal on Tuesday, March 21, 2023, which has Mr. Peter Obi and the Labour Party as the petitioners and with four respondents.

The respondents are:

  1. The Independent National Electoral Commission (INEC)
  2. Senator Bola Ahmed Tinubu
  3. Senator Kashim Shettima, and,
  4. All Progressives Congress (APC).

In point number 28 of the petition, the Petitioners had contended that Tinubu was at the time of the election not qualified to contest for election to the office of President as he was fined the sum of $460,000.00 (four-hundred and sixty thousand United States Dollars) for an offence involving narcotics trafficking imposed by the United States District Court, Northern District of Illinois, Eastern Division, citing Case No: 93C 4483 between
the United States of America, as the Plaintiffs, and

  1. Bola Ahmed Tinubu
  2. FUNDS IN ACCOUNT 263226700 HELD BY FIRST HERITAGE BANK, IN THE NAME OF BOLA TINUBU,
  3. FUNDS IN ACCOUNTS 39483134, 39483396, 4650279566, 00400220, 39936404, 39936383 HELD BY CITIBANK, N.A., IN THE NAME OF BOLA TINUBU OR COMPASS FINANCE AND INVESTMENT CO., and,
  4. FUNDS IN ACCOUNTS 52050-89451952, 52050-89451952, 52050-89451953 HELD BY CITIBANK, INTERNATIONAL, IN THE NAME OF BOLA TINUBU

as the Defendants.

In the Decree of Forfeiture, Judge John A. Nordberg in that said Case, on October 4, 1993, ordered that the fluids in the amount of $460,000 in account 263226700 held by First Heritage Bank in the name of Bola Tinubu represent the proceeds of narcotics trafficking or were involved in financial transactions in violation of 18 U.S.C. §§1956 and 1957 and therefore these funds are forfeited to the United States pursuant to 21 U.S.C. § 381(a)(6) and 18 U.S.C. §982.

It also ordered that First Heritage Bank shall issue a check in the amount of $460,000 payable to Federal Reserve Bank of Chicago and that these funds shall be disposed of according to law.

The above orders were made pursuant to paragraph 5 of the “Stipulations and Compromise Settlement of Claims to the Funds held by Heritage Bank and CitiBank” filed by the parties.

The orders were based on the Verified Complaint for Forfeiture, submitted by Michael J. Shepard (United States Attorney) and signed by Marsha A. McClellan (Assistant United States Attorney); Stipulations and Compromise Settlement of Claims to the Funds held by Heritage Bank and CitiBank; and, Decree of Forfeiture as to Funds held by First Heritage Bank, signed by United States District Judge, John A. Nordberg.

According to legal experts, the implication of the suit is that if the President of Nigeria is on trial for being a drug trafficker, the US drug agency may have to give testimony in court to substantiate the claims.

The attending hoopla from the world press may mount pressure on the Supreme Court of Nigeria to give a judgement acceptable to the international community.

Also, pundits noted that if the US testifies against Tinubu and declares him a former narcotics trafficker, the Supreme Court will have no option but to nullify his candidacy.
