The Court of Appeal has upheld the election of Smart Adeyemi as the Senator representing the people of Kogi West senatorial district at the National Assembly.
The Court also dismisses an appeal filed by Senator Dino Melaye over the Kogi West senatorial district election rerun.
The three-man panel of the court unanimously resolved all seven issues, identified for determination, against the appellant.
After resolving all seven issues, the panel upheld the judgment of the National Assembly Election Petition Tribunal which sat in Abuja delivered on June 10, 2020.
The judgment had affirmed the declaration by the Independent National Electoral Commission (INEC) over the election.
INEC had declared Adeyemi as winner of the said election.
Senator Melaye, consequently, took the matter to the appellate court.
The court struck out Adeyemi’s preliminary objection but ruled in his favour.
It also awarded N50,000 cost against Melaye in favour of the respondents.
